1. Introduction and acceptance

These Terms of Service ("Terms") govern your use of the website https://phaltronclixarem.world (the "Website") and the purchase of products offered thereon, including PhytoVigor (the "Product"), by Phaltronclixarem ("we", "us", "our", "Seller"). By accessing the Website, placing an order or using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or place orders.

2. Definitions

  • Consumer: any natural person who is acting for purposes outside his or her trade, business, craft or profession (as per EU and Italian consumer law).
  • Contract: the contract for the sale of the Product concluded between you and the Seller.
  • Order: your submission of an order via the Website (e.g. order form) for the Product.
  • Product: PhytoVigor and any other goods offered for sale on the Website.

3. Use of the Website

You agree to use the Website only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Website in any way that violates applicable laws or regulations (including in Italy and the European Union).
  • Transmit any harmful, offensive, defamatory or illegal content, or any malware or code that could harm our or third parties' systems.
  • Attempt to gain unauthorised access to our or third parties' systems, accounts or data.
  • Use automated means (e.g. bots, scrapers) to access or collect data from the Website without our prior consent.
  • Impersonate any person or entity or misrepresent your affiliation.

We reserve the right to suspend or restrict access to the Website, or to terminate your use, if we reasonably believe you have breached these Terms or applicable law.

4. Product information and nature of the Product

PhytoVigor is a food supplement (integratore alimentare) and not a medicine. It is not intended to diagnose, treat, cure or prevent any disease. Product descriptions, images and information on the Website are for informational purposes and may be updated from time to time. We strive to ensure that information is accurate but do not warrant that descriptions or other content are error-free. The Product is intended for adults as part of a balanced diet and healthy lifestyle. If you have a medical condition or are taking medication, consult your doctor before use.

Prices displayed on the Website are in euros (€) and include VAT where applicable under Italian law. Prices do not include delivery unless otherwise stated (e.g. "free shipping" where conditions are met). We reserve the right to correct pricing errors and to change prices; any order already accepted at the correct price will be honoured.

5. Orders and conclusion of the contract

By submitting an order (e.g. completing the order form and clicking the order button), you make an offer to purchase the Product on the terms stated on the Website at that time. We will send you an order confirmation by email once we have received your order. A contract between you and us is formed when we send you that order confirmation (or when we accept your order in another way we communicate to you). We are not obliged to accept every order; we may refuse or cancel an order in cases such as stock unavailability, pricing errors, suspected fraud, or failure to pass internal checks.

You are responsible for providing correct and complete contact and delivery details. If you do not provide required information or it is incorrect, we may not be able to process or deliver your order, and we shall not be liable for any resulting delay or failure.

6. Payment and delivery

Payment methods and delivery options are as indicated on the Website at the time of order. You must pay the price and any applicable delivery charges in full. We will deliver the Product to the address you provide, subject to these Terms and our delivery policy. Delivery times are indicative; we are not liable for delays caused by carriers or force majeure. Risk in the Product passes to you upon delivery to the carrier (for delivery to you) or upon delivery to you (if collected). Title passes when we have received full payment.

7. Consumer rights (withdrawal and returns)

If you are a Consumer, you have the right to withdraw from the Contract within 14 days without giving any reason, in accordance with EU Consumer Rights Directive and Italian law (D.Lgs. 206/2005). The withdrawal period expires 14 days after the day on which you (or a third party indicated by you) acquire physical possession of the goods. To exercise the right of withdrawal, you must inform us of your decision by a clear statement (e.g. by email or post). Your right of withdrawal does not apply in the cases set out in Art. 59 of the Consumer Rights Directive (e.g. sealed goods which are not suitable for return due to health protection or hygiene reasons if unsealed after delivery). 8. Warranty and liability

We warrant that the Product will conform to the contract and to the description on the Website at the time of delivery. In relation to Consumers, statutory rights (e.g. conformity under EU Consumer Sales Directive and Italian law) apply. If the Product is defective or not in conformity, you may be entitled to repair, replacement, price reduction or rescission, and to compensation where provided by law.

Except as required by mandatory law (e.g. for death or personal injury caused by our negligence, or fraud): (a) we shall not be liable for any indirect, consequential or incidental losses; and (b) our total liability under or in connection with the Contract or the use of the Website shall not exceed the price paid by you for the Product in the order in question.

We do not exclude or limit liability that cannot be excluded or limited under applicable law in your jurisdiction.

9. Intellectual property

All content on the Website (texts, graphics, logos, images, layout, software) is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute or use such content for commercial purposes without our prior written consent. You may view and print pages for personal, non-commercial use.

11. Complaints and dispute resolution

If you are a Consumer in the European Union, you may use the European Commission's online dispute resolution platform (ODR): ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution but may do so voluntarily.

12. Applicable law and jurisdiction

These Terms are governed by the laws of Italy. If you are a Consumer resident in the European Union, you also benefit from the mandatory consumer protection provisions of your country of residence. For disputes involving Consumers, the courts of the Consumer's place of residence may have jurisdiction in accordance with applicable law; otherwise, the courts of Rome, Italy, shall have jurisdiction.

13. Changes to the Terms

We may amend these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Changes will apply to orders placed after the update. If you have already placed an order, the Terms in effect at the time of that order apply to that order. We encourage you to review these Terms periodically.
