Return Policy

1. Introduction and scope

This Return Policy describes your right to withdraw from the contract and to return the product when you purchase PhytoVigor or other products from Phaltronclixarem ("we", "us", "our") via the website https://phaltronclixarem.ddd. It applies to consumers (natural persons acting outside their trade, business, craft or profession) in accordance with EU Directive 2011/83/EU (Consumer Rights Directive) and Italian Legislative Decree 206/2005 (Consumer Code).

2. Right of withdrawal (14 days)

If you are a consumer, you have the right to withdraw from the contract within 14 (fourteen) days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party authorised by you (other than the carrier), take physical possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision by a clear statement. You may use the following:

  • Email to: office@phaltronclixarem.world with subject "Withdrawal" and your order reference, name, address and date of receipt of the goods.
  • Post to: Phaltronclixarem, Via del Corso, 497/498, 00186 Roma RM, Italy.
  • The model withdrawal form provided by the European Commission (you can find it on the European Commission website or request it from us).

To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the 14-day period has expired.

3. Effects of withdrawal and return of goods

If you withdraw from the contract, we shall reimburse all payments received from you, including delivery costs (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods unless we have agreed to bear them or we have failed to inform you that you must bear them. We recommend that you use a traceable delivery method and keep proof of posting.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. In other words, you may try the product to the extent necessary to determine whether you wish to keep it; beyond that, we may hold you liable for any decrease in value (e.g. if the product has been used excessively or the packaging opened in a way that affects resale).

4. Exceptions to the right of withdrawal

Under Art. 59 of the Consumer Rights Directive, the right of withdrawal does not apply to:

  • The supply of goods sealed for health protection or hygiene reasons that are unsealed after delivery (e.g. sealed capsules or bottles that have been opened). For PhytoVigor: if the product is sealed and you unseal it, the right of withdrawal may be lost in some jurisdictions; we will inform you before or at the time of order if we consider that exception to apply, and we may still accept returns on a voluntary basis in accordance with paragraph 5 below.
  • The supply of goods that are clearly personalised.
  • The supply of goods which are liable to deteriorate or expire rapidly.
  • Other cases set out in Art. 59.

5. Voluntary return and goodwill policy

Even where the legal right of withdrawal does not apply (e.g. because the product has been unsealed or used), we may at our discretion accept returns or offer a partial refund in cases of defective or non-conforming goods, or as a gesture of goodwill. Any such acceptance does not waive our position under the law. To request a voluntary return or to report a defect, contact us at the details above with your order number and a short description. We will respond with instructions (e.g. return address, any restocking conditions).

6. Defective or non-conforming goods

If the product is defective or does not conform to the contract (e.g. wrong product, damaged, expired), your statutory rights under the Consumer Sales Directive and Italian law apply. You may be entitled to repair, replacement, price reduction or rescission of the contract, and possibly compensation. In such cases, you do not have to pay for the return shipment of defective goods; we will reimburse the cost or arrange collection where appropriate. Contact us as soon as you discover the defect or non-conformity.

7. How to return the product

To return the product after a valid withdrawal (or where we have agreed to a voluntary return):

  1. Contact us to confirm the return (e.g. by email with your order reference). We will confirm the return address and any reference number to include.
  2. Pack the product securely, ideally in its original packaging if possible, and include a copy of your order confirmation or a note with your name and order number.
  3. Send the package to the address we provide. Use a traceable service and keep proof of posting. For withdrawal within the legal period, you bear the return cost unless we have agreed otherwise.
  4. Once we receive the product and verify it, we will process the refund within the timeframe stated in section 3 (generally within 14 days of receiving your withdrawal notice or the goods, whichever is later).

8. Refund method and timing

Refunds will be made using the same payment method you used for the original transaction, unless you have expressly agreed to a different method. We will not charge you any fee for the refund. If the original payment was made by card, the refund will be credited to the same card; processing may take a few additional days depending on your bank or card issuer. If you paid by other means (e.g. bank transfer, PayPal), we will refund to the same account or method where possible.

We may update this Return Policy from time to time. The updated version will be posted on this page with a revised "Last updated" date. Changes do not affect your rights in relation to orders already placed; the policy in effect at the time of your order applies to that order. We encourage you to review this policy when placing a new order.
